These Terms apply to your use of Photon, a Switzerland-based Windows desktop app for PC performance diagnostics and optimization guidance, together with its website, license service, downloads, API, and Discord bot.
By purchasing, redeeming, activating, downloading, or using Photon, you agree to these Terms, the Privacy Policy, and the Refund Policy presented with your purchase.
You must be legally capable of entering into this agreement. If the law that applies to you requires permission from a parent or guardian, you may use Photon only with that permission.
Nothing in these Terms removes rights that applicable law does not allow you to waive.
Photon requires a valid and active license or access key. Unless stated otherwise on the product page, your license is personal, limited, non-exclusive, non-transferable, and valid for the purchased duration.
Your license may not be shared, resold, rented, leaked, transferred, or used to provide access to another person without permission.
Access may be limited by license duration, device activation, supported app version, payment status, and license status. Plans shown as one-time purchases do not automatically renew.
Photon may bind your license to a derived device identifier to prevent unauthorized sharing.
If you change hardware or reinstall Windows, you may need to request a device reset. Repeated, fraudulent, or abusive reset requests may be refused.

Photon scans are intended to be read-only. A system change occurs only when you choose to apply an individual fix, use Fix All, run an Internet repair, close a selected process, or otherwise explicitly start an action.
You are responsible for reviewing a fix before applying it and for keeping appropriate backups of important files and settings.
Some actions may change Windows settings, interrupt networking, close a selected process, affect another application, or require a restart. Manual recommendations are not performed automatically by Photon.
Photon provides diagnostics, measurements, recommendations, and user-initiated optimization actions. Results depend on the information exposed by Windows, your hardware, drivers, software, games, workloads, and current system condition.
We do not guarantee any specific FPS increase, latency reduction, temperature improvement, stability improvement, Internet speed increase, or other performance result.
Photon is not a security product, hardware warranty, professional repair service, or guarantee that every recommendation is suitable for every PC.
Purchases are processed through the storefront or payment provider shown at checkout. Prices, currencies, taxes, payment methods, and delivery details are shown before the purchase is completed.
Photon is a digital product. Except where the Refund Policy or applicable law requires otherwise, all purchases are final once a license or access key has been delivered, revealed, redeemed, or activated, or once digital access has started.
Refunds are not provided solely because you changed your mind, expected a larger performance improvement, failed to review the system requirements, or no longer want to use Photon.
Refund requests involving unauthorized payments or a verified technical defect that prevents Photon from performing its core purchased functions will be handled under the Refund Policy.
Where applicable law requires separate consent before immediate digital delivery begins or before a withdrawal right is lost, that consent must be provided during checkout.
Nothing in these Terms removes refunds, remedies, warranties, or other consumer rights that applicable law does not allow to be excluded.
We may suspend, ban, revoke, or cancel access where there is reasonable evidence of license sharing, resale, fraud, abuse, tampering, unauthorized access, a security threat, an unpaid or reversed payment, or another material violation of these Terms.
Urgent action may be taken without advance notice when reasonably necessary to protect Photon, its systems, or its users.
You may contact Photon support if you believe a restriction was applied incorrectly. Where practical and safe, disputed restrictions may be reviewed.
Photon may require updates to continue working. Access may be limited or blocked for outdated, insecure, revoked, unsupported, or incompatible versions.
Features may be changed, replaced, restricted, or removed as Photon, Windows, drivers, hardware support, and security requirements change.
Maintenance, updates, failures, or third-party outages may temporarily interrupt the app, website, API, Discord bot, license service, or downloads. We do not guarantee uninterrupted availability.
Photon may use third-party services such as payment providers, storefronts, Discord, hosting providers, and download infrastructure.
These services may have their own terms and privacy policies. Photon is not responsible for the availability, operation, or conduct of independent third-party services.
This section does not limit any responsibility Photon has under applicable mandatory law.
Photon is provided as-is and as available, except for promises expressly stated in these Terms or rights provided by applicable mandatory law.
To the maximum extent allowed by law, Photon is not liable for lost profits, lost revenue, lost data, lost settings, system issues, game issues, software conflicts, network interruptions, downtime, or indirect, incidental, special, or consequential damages arising from the use of or inability to use Photon.
Nothing in these Terms excludes or limits liability or consumer rights that applicable law does not allow to be excluded or limited, including liability for intentional misconduct or gross negligence.
We may update these Terms when reasonably necessary for legal, security, operational, payment, or product reasons.
The updated date will be changed when a new version is published. Material changes will apply from their stated effective date and, where appropriate, may also be announced through the website, app, or Discord server.
Continued use of Photon after updated Terms take effect means you accept them where permitted by law. Changes do not remove rights that already arose under an earlier purchase or under applicable mandatory law.
These Terms are governed by Swiss law, excluding its conflict-of-law rules.
Mandatory consumer laws and mandatory places of jurisdiction that apply based on your country of residence remain unaffected.
